Recall Genie provides tools for automatically generating digital flashcards from user‑uploaded documents. Flashcards may include cloze deletions, basic question‑answer formats, and other educational structures. These outputs are compatible with third‑party study tools such as Anki.

The Services are intended solely for personal, academic, or internal business use. They are not intended for resale or redistribution.

3. User Obligations and Prohibited Uses

3.1 Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not:

• Violate any laws, regulations, or third‑party rights.
• Upload content you do not have permission to use.
• Interfere with, disrupt, or harm the Services or infrastructure.
• Reverse‑engineer, scrape, decompile, or extract source code.
• Use bots, spiders, or similar automated tools to access the Services.

3.2 User Content Responsibility

You are solely responsible for any files, documents, or data you upload. You confirm:

• You own or have obtained all necessary rights for the content.
• The content is not illegal, infringing, defamatory, or harmful.
• The content does not contain malware, viruses, or corrupted files.

We reserve the right to delete or restrict access to any content that violates these Terms or poses a risk to the platform or its users.

3.3 No Educational Guarantee

Recall Genie is a tool to aid in studying. We do not guarantee:

• Accuracy or completeness of generated flashcards.
• Improvement in academic performance.
• Success in exams, certifications, or standardized tests.

Use of the Services does not substitute for professional tutoring or educational instruction.

4. Intellectual Property

All content, code, branding, designs, algorithms, and features of the Services are the property of Recall Genie or its licensors. These are protected by intellectual property laws.

4.1 Limited License

We grant you a limited, revocable, non‑transferable, non‑sublicensable, and non‑exclusive license to use the Services solely for personal, academic, or internal purposes. You may not:

• Reproduce, sell, or redistribute flashcards.
• Use our platform outputs for commercial gain.
• Create derivative platforms using our technology.

5. Payments and Refunds

5.1 Pricing

All prices are in USD and may change without notice. Pricing may vary based on subscription tier, usage volume, or promotional offers.

5.2 Payment Methods

Payments are processed through third‑party vendors. By entering payment details, you authorize us to charge your selected payment method.

5.3 Refunds

All sales are final once flashcards are generated. Refunds are not issued except where legally required.

6. Account Termination and Suspension

We may suspend or terminate your access to the Services at any time for any reason, including:

• Breach of these Terms
• Fraudulent behavior
• Abusive conduct toward our platform or team

You may terminate your account by discontinuing use. Termination does not entitle you to a refund.

7. Arbitration and Dispute Resolution

Before pursuing legal action, you agree to attempt to resolve any dispute informally by contacting us at recallgeniehq@gmail.com.

If unresolved, any claim or dispute shall be settled by binding arbitration administered by the ADR Institute of Canada. Class action lawsuits are not permitted. This arbitration clause applies to all disputes arising out of or related to your use of the Services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RECALL GENIE, ITS OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR PROFITS, ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

IF OUR LIABILITY IS FOUND TO EXIST, IT IS LIMITED TO THE AMOUNT PAID BY YOU TO US IN THE PAST 12 MONTHS.

9. No Liability for User Content

Recall Genie is not responsible for the content you upload or generate using our Services. We do not endorse or verify the accuracy, legality, or educational value of user‑uploaded material.

You are solely responsible for:

• Ensuring your uploaded documents are accurate and properly formatted.
• Ensuring your use of the content complies with applicable laws.
• Any consequences arising from sharing or using the flashcards generated.

We may remove or restrict access to user content at our sole discretion.

10. Privacy

Your use of the Services is governed by our Privacy Policy, which outlines how we collect, use, and safeguard your personal data. By using the Services, you consent to our data practices.

11. Modifications to These Terms

We reserve the right to revise these Terms at any time. Changes will be posted on our website with the updated Effective Date. Continued use of the Services constitutes your acceptance of the revised Terms.
